On February 7, 2024, the California Court of Appeal Fourth Apellate District Division Three unanimously affirmed the Superior Court's order granting a preliminary injunction with the followign statement: "The order granting a preliminary injunction is affirmed." In short, we won and the ALA lost their senseless and expensive appeal.
The decision means that the TEMPORARY injunction granted by the Superior Cour Judge holds and is reinforced. As such, there is no change to your lake access or means for that access. This also means that the likelihood of us prevailing at trial is exceptionally high.
Unless a settlement is reached with the ALA the next steps are to prepare for the Trial, which is scheduled for May 2025. This means extensive discovery, depositions, filings, and trial preparations. These steps will at least double the parties' legal costs.
Absolutely not! As both the Superior Court and Appellate Court Judges have affirmed, it remains that the lake is only acccessible to Arrowhead Woods property owners, their guests, and their lessees.
While the both the Superior Court and Apellatte Court Judges have put forth their thoughts on this matter, we cannot currently advise how you manage your membership. Note that the 1964 Agreement (linked below) grants all Arrowhead Woods property owners, their guests, and their lessees rights to recreational use of the lake. You can exercise this right without a Membership to the ALA.
In their infinite wisdom the ALA still requires wristbands and registration for guests. In addition, as of the 2024, season ALA will be requiring a new bright pink badge for your guests to use. We do not condone "scarlet letters" on Arrowhead Woods property owners, their guests, or their lessees. For the record, the ALA's STR Committee made this decision without an ALA Board vote. The ALA has advised Dock owners of the following:
"The ALA does not have the authority to tell a private owner of a dock whom to allow onto that private dock. Such a decision is at the sole discretion of the private dock owner, or, if applicable, an association of the owners of a multi-slip dock. " (emphasis added) - June 26th 2023
